Yes, private school costs are tax deductible in Germany, but only under certain conditions. The Income Tax Act (§ 10 (1) No. 9 EStG) allows 30 percent of the tuition paid, up to a maximum of €5,000 per child per year, to be deducted as special expenses (Sonderausgaben). This applies only if the school meets certain state recognition criteria.

Many parents considering a private school for their child sooner or later ask themselves whether they can deduct tuition from their taxes. In this article, we explain step by step exactly what the criteria are and what matters.

Under What Conditions Can Tuition Be Deducted From Your Taxes?

As a general rule, tuition for a recognized private school can be claimed for tax purposes. The tax office recognizes 30 percent of the tuition paid as special expenses. What is important is that the school must be a state-recognized Ersatzschule (substitute school) or correspond to an approved Ergänzungsschule (supplementary school) with certain characteristics.

International schools and other private educational institutions do not automatically fall into this category. Whether a specific school meets the requirements can be checked directly with the school or with the responsible tax office.

Which Types of Private Schools Are Recognized by the Tax Office?

Not every private school automatically qualifies for a tax deduction. The Income Tax Act specifies that the following types of schools are generally recognized:

  • State-recognized or state-approved Ersatzschulen in Germany, i.e., schools that substitute for public schools and whose diplomas are recognized by the state
  • Schools in other EU and EEA countries, provided they meet comparable requirements
  • German schools abroad that are funded by the federal government

Pure Ergänzungsschulen without state recognition generally do not fall under this rule. If you are unsure whether your child’s school meets the requirements, it is worth looking at the school’s official approval notice or having a quick conversation with a tax advisor.

How Much Tuition Can You Deduct From Your Taxes?

The tax office recognizes 30 percent of the tuition actually paid as special expenses. However, there is a cap: A maximum of €5,000 per child per year can be deducted as special expenses. This corresponds to tuition of up to around €16,667 per year before the cap applies.

An example calculation: If you pay €10,000 in tuition per year, you can claim €3,000 (i.e., 30 percent) on your tax return. How much this actually saves in the end depends on your personal tax rate. At a tax rate of 35 percent, this would mean tax savings of around €1,050.

Important: Costs for childcare, meals, or accommodation do not count as deductible tuition and are not taken into account by the tax office.

How Do You Enter Tuition on Your Tax Return?

Entering tuition on your tax return is easier than many people think. You enter the costs in the Anlage Kind (the child schedule), which you fill out separately for each child. It has its own section for tuition and special expenses related to schooling.

You should have the following documents ready:

  • The school’s annual invoice or receipts for the tuition paid
  • Proof of the school’s state recognition (for example, a corresponding letter from the school)
  • If applicable, bank statements as proof of payment

What Is the Difference Between an Ersatzschule and an Ergänzungsschule?

This difference is particularly relevant to the question of tax deductibility. German school law fundamentally distinguishes between two types of private schools:

  • Ersatzschulen are private schools that substitute for public schools. They are subject to state approval and supervision, must follow certain curricula, and award state-recognized diplomas. Their tuition is tax deductible under the conditions described above.
  • Ergänzungsschulen supplement the public school system but are not intended to replace public schools. They have more freedom regarding curricula and diplomas but are subject to less strict state requirements. Tuition for Ergänzungsschulen is generally not tax deductible, unless they meet special requirements.

Are International Schools Ersatzschulen or Ergänzungsschulen?

Many international schools in Germany are recognized as Ergänzungsschulen. This does not mean that they offer a lower-quality education – quite the opposite. It does, however, have a direct impact on the tax treatment of tuition.

Which Private School Costs Are Not Deductible?

Even if tuition is generally deductible, there are a number of expenses that the tax office does not recognize. These include:

  • Costs for accommodation and meals, such as boarding fees or cafeteria fees
  • Childcare fees for before- and after-school care
  • Costs for school outings, class trips, or sporting events
  • Textbooks, materials, and school uniforms
  • Tutoring that is billed separately

That sounds like a lot of exceptions, but in practice it is easy to manage: Anything directly related to instruction and listed as tuition can generally be claimed. Everything else is excluded. If the school lists different items on its invoice, you should make sure to enter only the pure tuition amount.
